Any reference to “Amcal”, “Sigma”, “we”, “us”, “our” are references to Sigma and its related body corporates as applicable (including Amcal). Any reference to Sigma Personnel is a reference to the directors, officers, employees, agents, representatives, consultants and contractors of Sigma or its related bodies corporate as applicable.
Amcal reserves the right to amend these terms & conditions without notice to you from time to time. If Amcal decides to change these terms & conditions, it will post those changes here. Amcal encourages you to visit this section of the Site regularly in order to remain informed of any changes. Any such amendment will be effective once the revised terms have been posted on this Site.
Any provision in these terms & conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these terms & conditions or affecting the validity or enforceability of that provision in any other jurisdiction.
Amcal’s failure to exercise or enforce any right or provision of these terms & conditions shall not constitute a waiver of such right or provision.
These Terms constitute the entire agreement between Amcal and you and govern the use of the Site. You may also be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

Amcal does not warrant that the Site will be available at all times. Users acknowledge that the Site may be unavailable for a number of reasons, including due to matters beyond Amcal’s control, and shall not hold Amcal accountable in respect of any claims arising there from. Amcal does not warrant that users’ access to the Site will meet any particular performance criteria.

Item availability & catalogues

Not all items displayed in our catalogues will be available to purchase. These products are available at participating Amcal stores while stocks last.

Collection of information other than personal information

If you visit our website, some of the information we and/or our contractors collect about your visit to our website is not personal information because it does not reveal your identity. Information of this nature can include:

Amcal is not responsible for the content of any Third Party Websites, and makes no warranty about the completeness, timeliness, suitability, accuracy or subject matter of the material located on Third Party Websites. We do not approve of, endorse, or sponsor any content or Material on Third Party Websites. When you access a Third Party Website from this Site, you leave this Site and do so at your own risk. You are responsible for viewing and complying with the terms and conditions of use posted on the Third Party Websites.

Your account obligations

In consideration of your use of the Site, you agree to:

• Provide true, accurate, current and complete information about yourself as prompted by the Amcal Rewards registration form (the Registration Information); and
• Maintain and promptly update the Registration Information to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your registration and refuse any and all current and future use of the Site.
You are responsible for maintaining the confidentiality of your password and registration and are fully responsible for all activities that occur under your password and registration. You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security. Amcal considers this Registration Information private. The information is kept on a secure server to protect it from outside parties. We use the information only for the limited purposes of statistical purposes to improve our site and services to you, to administer our site, and to notify you of products or special offers that may be of interest to you.

Your conduct

You must only access and use the Site in accordance with these Terms. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site, use of the Site, or access to the Site. You agree not to access the Site by any means other than through the interface that is provided by us for use in accessing the Site.You must not post on or transmit via this Site any information or material that is offensive, threatening, breaches any laws or regulations, infringes a third party’s rights or is a breach of privacy or is otherwise deemed as inappropriate by us in our sole discretion. Amcal may terminate your access, or suspend your access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party Provider, Merchant, Sponsor, Licensor, service provider, or us.

Pricing errors

We strive to ensure that all product pricing and information displayed online and in-store is accurate. However, in the event a product is marked with an incorrect price due to a typographical error or incorrect pricing received from our suppliers, Amcal reserves the right to refuse to sell the product at the incorrect price. We appreciate your understanding in such circumstances, and any discrepancies will be addressed at the point of sale.

Applicable law

As far as legally possible this Agreement, its terms and conditions and the Use of this Site shall be governed by the laws in existence from time to time in Australia. Any claim relating to the Site, the services provided through the Site or the Content shall be governed by the internal laws of the state of Victoria and you agree to submit to having the matter dealt with in a court in Melbourne in the state of Victoria Australia.

Termination

These terms are effective even if this Agreement is terminated by either party. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be affected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your registration and all related information and files under your registration and bar any further access to such files or the Site. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the Site.

Concerns regarding Terms

Should you object to these Terms or any subsequent modifications thereto or become dissatisfied with this Site, your only recourse (to the extent permitted by law) is to immediately terminate your use of this Site.

Introduction

These are the terms and conditions that apply to all Amcal Gift Cards issued by Sigma Company Limited ACN 004 132 923 (Sigma).
It is recommended that you read this document carefully before using the Amcal Gift Card.

Terms and Conditions

1. The following terms have the following meanings in this document:
   1. Amcal means Sigma Company Limited ACN 004 132 923 and any participating Amcal Franchised Pharmacy Business;
   2. Amcal Franchised Pharmacy Business means the business of conducting in accordance with the terms of a franchise agreement an Amcal pharmacy for the retail of goods and services using the intellectual property and other rights of Amcal;
   3. Amcal Gift Card means the gift card that you have purchased or received;
   4. Franchisee means a third party to whom Amcal has licensed and granted the right under a franchise agreement to operate a Amcal Franchised Business;
   5. Issue Date means the date noted on your Amcal Gift Card;
   6. Remaining Gift Card Value means at any time, that portion of the initial value loaded onto your Amcal Gift Card;
   7. A reference to “we” or ”us” is a reference to Sigma or any participating Amcal Franchised Pharmacy Business; and
   8. A reference to ”you“ or “your” is a reference to the person who is in possession of the Amcal Gift Card at the relevant time for the purposes of these Gift Card Terms and Conditions, or who authorises another person to do something with or to the Amcal Gift Card on their behalf.
2. These terms and conditions apply to each Amcal Gift Card issued.
3. By purchasing, activating, redeeming or attempting to redeem an Amcal Gift Card, you agree to be bound by these Gift Card Terms and Conditions and all applicable laws and regulations; and not to use the Amcal Gift Card in any way that is unlawful, misleading, deceptive, unfair or causes harm or damage to any other person.
4. If you give the Amcal Gift Card to another person, then you must ensure the person to whom you gave the Amcal Gift Card is aware of these Gift Card Terms and Conditions, as well as the Remaining Gift Card Value and expiry date of the Amcal Gift Card.
5. The Amcal Gift Card is redeemable in whole or in part for goods or services sold in a participating Amcal Franchised Pharmacy Business.
6. The Amcal Gift Card is redeemable for purchases of $5.00 or more.
7. The Amcal Gift Card cannot be redeemed for purchases via amcal.com.au.
8. The Amcal Gift Card is valid for three (3) years from the Issue Date.
9. The Amcal Gift Card is not redeemable for cash and cannot be used for the payment of credit or retailer accounts.
10. The Amcal Gift Card cannot be reloaded.
11. The Amcal Gift Card is wholly or partially redeemable. It is up to you to use the full value displayed on the Amcal Gift Card before the expiry date.
12. Where the cost of a purchase exceeds the value displayed on the Amcal Gift Card or any unused Remaining Gift Card Value, you will be required to make up the difference with another payment method.
13. Any unused Remaining Gift Card Value on expiry of the Amcal Gift Card will not be refunded or credited to you.
14. Treat the Amcal Gift Card like cash.
15. Amcal may cancel the card if you report it has been lost or stolen.
16. Amcal accepts no responsibility for defaced, damaged, altered, lost or stolen Amcal Gift Cards and will not take any responsibility, or replace, or refund, if damaged, lost or stolen.
17. You can check an Amcal Gift Card balance at any time by calling 1300 554 268.
18. Amcal reserves the right to change any of the terms contained in these Gift Card Terms and Conditions at any time where the change is reasonably required and agrees to provide you with at least 30 days’ advance notice of such changes. Amcal will give you notice by posting the changes to https://www.amcal.com.au/termsandconditions. If you write to Amcal within the notice period and do not accept the changes, we may cancel your Amcal Gift Card and refund any Remaining Gift Card Value to you. Changes to these Gift Card Terms and Conditions Terms will be available on the Amcal website.
